The Validation of Debt Letter is very different than the Hardship Letter. When drafting a Hardship Letter, there is an opportunity for you to add details about your situation and hardship. With the Validation of Debt Letter, you should not add information about your personal case or finances. The Validation of Debt Letter is only to put the collector on notice that you are requesting from them proof that the debt they are collecting on is yours and that they have the right to collect on this debt. The Validation of Debt letter is not the place to go into details about yourself with the collector.
Requesting Validation from a third party collection firm is your right under the Fair Debt Collection Practices Act. Because of that, it is important that the letter be written properly. The only information you should add is optional call control language after the collector has validated the debt.
